Terms of Service

Welcome to ilysia ("the App"), operated by Semih Karakaya ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms of Service. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have obtained consent from a parent or legal guardian. Children under 13 may not use ilysia, and ilysia is not positioned in the App Store Kids Category. By using the App, you represent that you meet these requirements.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms. All rights not expressly granted are reserved.

3. Account & Registration

Certain features may require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

4. Subscriptions & Purchases

The App offers auto-renewing subscriptions through the Apple App Store and Google Play Store. Payments are processed by the respective app store and are subject to their terms.

Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period.
You can manage and cancel subscriptions in your App Store or Google Play account settings.
Any unused portion of a free trial period is forfeited upon purchasing a subscription.
Refunds are handled by the app store provider in accordance with their policies.

5. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable law.
Attempt to reverse engineer, decompile, or tamper with the App's code or infrastructure.
Upload or transmit viruses, malware, or any code designed to disrupt the App.
Abuse the AI analysis features by submitting inappropriate, offensive, or non-skin-related content.
Create multiple accounts to circumvent free usage limits or referral systems.
Scrape, crawl, or extract data from the App without our prior written consent.

6. AI Analysis & Disclaimer

The App uses artificial intelligence to provide skin analysis, skincare routines, product guidance, and progress insights. These analyses are for informational and educational purposes only and do not constitute medical advice.

Important: ilysia is not a medical device and does not diagnose, treat, cure, or prevent any skin disease or medical condition. Always consult a qualified dermatologist or healthcare professional for medical advice.

Analysis results may vary based on image quality, lighting conditions, and other factors. We make no guarantees regarding the accuracy, completeness, or reliability of AI-generated analyses.

7. User Content

You retain ownership of any photos, images, or other content you submit through the App ("User Content"). By submitting User Content, you grant us a worldwide, royalty-free license to process and use the content solely for the purpose of providing the App's requested features. Before third-party AI processing, the App asks for permission to share relevant face photos, product photos, product details, ingredient lists, and structured skin results with the AI providers described in the Privacy Policy. Your raw face photos are processed for the requested scan and are not stored on ilysia servers or used by ilysia for AI model training. OpenRouter routes selected requests to Xiaomi MiMo. Xiaomi MiMo's platform policy states API content is not used for model training or other purposes, and Google Gemini is not permitted to use this data to train AI models. Structured results may be stored as described in the Privacy Policy.

You represent that your User Content does not infringe any third-party rights and that you have all necessary permissions and consents.

8. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data. By using the App, you consent to the practices described in the Privacy Policy.

9. Third-Party Services

The App integrates with third-party services including but not limited to:

Firebase (Google) — Authentication, database, storage, analytics, crash reporting, and cloud functions.
OpenRouter — AI routing for skin analysis and product-photo guidance.
Google Gemini — AI-powered skin analysis, routines, product guidance, and insights.
RevenueCat — Subscription and in-app purchase management.
Google ML Kit — On-device text recognition and face detection.

These services have their own terms and privacy policies. Our Privacy Policy explains what data may be shared with these providers and the protections we require for personal data.

10. Intellectual Property

The App, including its code, design, branding, and content (excluding User Content), is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

11. Termination

We may suspend or terminate your access to the App at any time, without notice, if you violate these Terms or if we believe your actions may harm the App, its users, or our interests. Upon termination, your license to use the App ends immediately. You may request deletion of your account and associated data at any time within the App.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APP.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any third-party rights.

15. Changes to Terms

We may update these Terms from time to time. Updated versions will be posted on this page with a new "Last updated" date. Material changes will be notified through the App or via email. Your continued use after changes take effect constitutes your acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Istanbul, Turkey.
